Neil Selman and Linda Wendell Hsu will be presenting at the American Conference Institute’s (ACI) 31st National Forum on Bad Faith Claims & Litigation on July 27-28, 2015, in Chicago, Illinois. Neil will be presenting on "Understanding the Scope and Limits of Duty to Defend, Duty to Settle, and Initiating Settlement Negotiations." This topic includes a discussion of the Duty to Defend in light of Post v. St. Paul Travelers (3rd Circuit), the Duty to Settle Claims in light of Du v. Allstate Insurance Company (9th Circuit), liability for failure to settle within policy limits, and how some courts are expanding the carrier’s obligation to now include an obligation to initiate settlement negotiations.
