Commercial Litigation and Environmental Practice Groups Collaborate to Prevail in Commercial Lease Lawsuit

On the eve of trial, Selman Breitman's Commercial Litigation group was retained by a commercial real estate developer to assist in the defense of a suit brought by a tenant for negligence arising out of the tenant's alleged exposure to mold and other toxic substances on the premises.  SB's Environmental/Toxic Tort team was immediately involved and handled the trial preparation work and additional sessions of the plaintiff's deposition to narrow the claims to be tried.  At the same time, the Commercial Litigation team obtained a trial continuance, prevailed on several discovery motions, and then filed a Motion for Summary Judgment, which was granted by the court.  As the prevailing party, SB's client was awarded recovery of fees and costs incurred in the lawsuit.  This case was a great example of two practice groups working together to obtain a great result.  Congratulations and thanks to Teanna Buchner, Lara Kruska, Craig Maki and Bradford Hughes for their work on this challenging matter!
