Orange County Trial Team Prevails in Asbestos-Related Cancer Case
Often, it pays to stand firm in the face of an unreasonable settlement demand from plaintiff's counsel. Recently, Asir Fiola tried a case on behalf of two construction clients, who were alleged to have contributed to plaintiff's asbestos-related illness and increased risk of cancer in the future. After developing strong medical defenses, and after plaintiff's counsel expressed settlement expectations out of the ballpark of the value of the case, Asir started trial in Van Nuys.
A jury was picked. Opening statements were made. Plaintiff took the stand. And yet, the defense showed no inclination to give in to counsel's demand. Finally, plaintiff agreed to a voluntary dismissal of one of the clients, and accepted a nominal amount for the other client.
