Selman Breitman Obtains Summary Judgment on Behalf of Electrical Component Manufacturer in Mesothelioma Case
Partner Christine Calareso and Associate Matthew Brady from Selman Breitman's Orange County office represented an electrical component manufacturer in a matter venued in United States District Court Central District of California. Plaintiff alleged exposure to asbestos related to his career as an electrician at industrial, commercial and residential locations. A motion for summary judgment was filed on behalf of the client based on the fact that there was no evidence that plaintiff's work with the client's products caused plaintiff's mesothelioma. Plaintiff designated experts who would allegedly opine generally that work with electrical components exposed plaintiff to asbestos. However, there was no evidence that plaintiff actually worked with an asbestos-containing product manufactured by the client.
Extensive evidentiary objections were filed against plaintiff's experts, which the court found to be "well-taken." The court sustained the client's evidentiary objections, leaving plaintiff without any experts against the client. As such, the court found that plaintiff could not prove the element of causation against the client and there was no triable issue of fact. The court granted the motion for summary judgment in its entirety in favor of Selman Breitman's client.
